If you are married
If you are married when your child is born, you will be given shared custody automatically.
If the mother is separated
If you have been separated for more than 10 months before your child is born, the father is not automatically registered.
If the separation has been annulled, you must notify the municipality so that they can cancel the registration of the legal separation in the CPR.
If the legal separation still applies you should not take further action but wait until you will be contacted by the Agency of Family Law.
If the mother is unmarried - shared custody is wanted
Apply for shared custody AFTER the child is born
If the mother is unmarried when your child is born, the mother has sole custody. If the parents want to have shared custody, a Care and Responsibility Declaration for Paternity must be completed within 28 days after the birth. If you complete the declaration online after birth, it is automatically forwarded to the registrar (the mother's parish of residence or if the child is born in the Southern part of Jutland – to the municipality of residence).
f you complete the Care and Responsibility Declaration for paternity on paper, you must send it yourself to your registrar.
Apply for shared custody before the child is born
You can also complete the Care and Responsibility Declaration for Paternity before the child is born. The online declaration is automatically forwarded to the Agency of Family Law, who will then send their response to your Digital Post whereas the declaration on paper must be sent by yourself to your registrar.
Please note: Paternity cannot be registered in the CPR until after the child is born as this requires the child to have a civil registration number. You must send the confirmation you have received from the Agency of Family Law to the registrar within 28 days after the birth of the child.
If the mother is unmarried - the mother wants sole custody
f the mother is unmarried, and you do not want shared custody, the father must still be registered as a biological father in the CPR and you will be contacted by the Agency of Family Law regarding paternity.
