If you have joint custody
If you have joint custody, you must both sign the application to change the name of your child under 18 years of age.
The child must be consulted or give consent.
If you have sole custody
If you have sole custody, you can change the child's name without the consent of the other parent, however only if the change does not involve moving, changing or removing a family name that belongs to the other parent. The change of name must be processed by the Agency of Family Law, and the other parent has the right to be consulted.
You must initiate and sign the application, since you have sole custody.
The registrar will forward your application for further processing to the Agency of Family Law, who will contact you.
